Acceptable Use Policy

This Acceptable Use Policy (“AUP”) describes certain terms and conditions governing use of the Service offered by Get Weatherized, Inc. dba LayerUp (“GW,” “we,” or “us”) including through the Website and is binding on Customers and each individual accessing or using the Service. Capitalized terms used but not defined in this AUP have the meaning given them in our Terms of Service. The examples described in this AUP are not exhaustive. We reserve the right to modify this AUP at any time by posting a revised version on the Website. By using the Service or accessing the Website, you agree to the latest version of this AUP. If you violate this AUP or authorize or help others to do so, we may suspend or terminate your use of the Service.

  1. No Illegal, Harmful, or Offensive Use or Content. You may not use, encourage, promote, facilitate or instruct others to use, the Service or the Website for any illegal, harmful or offensive use, or to transmit, store, display, distribute or otherwise make available content that is illegal, harmful, or offensive. This includes but is not limited to the following in relation to the Service:
    1. Illegal Activities. Engaging in any illegal activities;
    2. Harmful or Fraudulent Activities. Engaging in activities that are deceptive or that may be harmful to others or to GW;
    3. Infringing Content. Submitting or transmitting content that infringes or misappropriates the intellectual property or proprietary rights of others;
    4. Offensive Content. Submitting or transmitting content that is defamatory, obscene, abusive, invasive of privacy, harassing, violent, or otherwise objectionable; or
    5. Harmful Content. Submitting or transmitting content or technology that may damage, interfere with, surreptitiously intercept, or expropriate any system, program, or data, including viruses, Trojan horses, worms, time bombs, or cancelbots.
  2. No Security Violations. You may not use the Service to violate the security or integrity of any network, computer or communications system, software application, or network or computing device (each, a “System”). This includes but is not limited to the following in relation to the Service: 
    1. Unauthorized Access. Accessing or attempting to access any System without permission, including attempting to probe, scan, or test the vulnerability of a System or to breach any security or authentication measures used by a System;
    2. Interception. Monitoring or interception of data or traffic on a System without permission; or
    3. Falsification of Identity or Origin. Creating a false identity or any attempt to mislead others as to the identity of the sender or the origin of any data or communications. 
  3. No Network Abuse. You may not make network connections to any users, hosts, or networks unless you have permission to communicate with them. This includes but is not limited to the following in relation to the Service:
    1. Monitoring or Crawling. Monitoring or crawling of a System that impairs or disrupts the System being monitored or crawled;
    2. Denial of Service (DoS). Inundating a target with communications requests so the target either cannot respond to legitimate traffic or responds so slowly that it becomes ineffective;
    3. Intentional Interference. Interfering with the proper functioning of any System, including any deliberate attempt to overload a system by mail bombing, news bombing, broadcast attacks, or flooding techniques;
    4. Operation of Certain Network Services. Operating network services like open proxies, open mail relays, or open recursive domain name servers; or
    5. Avoiding System Restrictions. Using manual or electronic means to avoid any use limitations placed on the Service or any System, such as access and storage restrictions.
  4. No E-Mail or Other Message Abuse. You will not distribute, publish, send, or facilitate the sending of unsolicited mass e-mail, text, or other messages, promotions, advertising, or solicitations (so-called “spam”).
  5. No Reverse Engineering. You will not engage in reverse engineering, copying, disassembling, or decompiling the Service.
  6. Our Monitoring and Enforcement.
    1. We reserve the right, but do not assume the obligation, to investigate any violation of this AUP or misuse of the Service or Website. 
    2. We may remove, disable access to, or modify any content or resource that and/or suspend access to the Service of a user who violates this AUP or any other agreement we have with you for access and use of the Service or the Website.
    3. We may report any activity that we suspect violates any law or regulation or this AUP to appropriate law enforcement authorities and other appropriate third parties and cooperate in any investigation of the same. Our reporting may include disclosing appropriate customer information. 
    4. If you become aware of any violation of this AUP, you will immediately notify us and provide us with reasonable assistance, as requested, to stop or remedy the violation.
